TikTok Card Breaker Sues Customer for $42,000 Over Chargebacks
A card breaker is suing a customer who spent $24,000 on breaks, then charged back $18,000 through TikTok’s payment system.
The Ballers Bank filed suit against Nicholas Albin in North Carolina court, seeking $42,000 total. The complaint was filed February 25, 2026.
What Happened
Albin bought boxes and packs through The Ballers Bank’s TikTok breaks over a four-day period in late November 2025. Total spent: $24,240.
A few weeks later, between December 18 and December 24, Albin charged back $18,586 through TikTok.
According to the complaint, Albin admitted in an email he owed the money but disputed the terms. He didn’t offer to pay or settle.
The TikTok Problem
Breaking on TikTok is different from Whatnot or Fanatics Live. On those platforms, the company handles payments and eats the chargebacks.
On TikTok, breakers process payments themselves. That means they’re on the hook when someone charges back.
Chargebacks are common in breaking. Customers dispute charges, breakers lose the product and the money. Too many chargebacks can put a breaker out of business.
What They’re Asking For
The Ballers Bank wants $42,826:
- $24,240 for the original purchases
- $18,586 from the chargebacks
- $10,000 in legal fees
The company’s terms of service say disputes go to arbitration. The lawsuit is asking the court to force Albin into arbitration.
The terms also allow the company to recover legal fees for “false/fake chargebacks.”
